TERMS AND CONDITIONS

1. Introduction and Acceptance
Welcome to Go With Rosie. These Terms and Conditions ("Terms") govern your access to and use of the website located at https://gowithrosie.com, our mobile applications, and all related services (collectively, the "Platform") provided by Go With Rosie, Inc., a Delaware corporation ("Company," "we," "us," or "our").
By creating an account, accessing or using the Platform, or by clicking to accept or agree to these Terms when this option is made available to you, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Platform.
IMPORTANT: These Terms contain a mandatory arbitration provision and class action waiver in Section 17, which affects your legal rights. Please read this section carefully.
2. About Our Platform
2.1 What We Do
Go With Rosie is a family travel platform that helps families discover, plan, and book travel experiences. Our Platform allows you to:
- Discover destinations, activities, and accommodations suitable for families
- Create and manage trip itineraries
- Book hotel accommodations through our third-party suppliers
- Receive personalized recommendations based on your family preferences
- Share and receive anonymized recommendations from families with similar profiles
2.2 Our Role
We are a booking platform and intermediary, not a travel provider. When you book accommodations through our Platform, the contract for the accommodation services is between you and the hotel or accommodation provider (the "Accommodation Provider"). We act as an agent to facilitate your booking through our third-party suppliers and distribution partners. We do not own, operate, manage, or control any Accommodation Provider, and we are not responsible for their acts, omissions, or the quality of their services. To the fullest extent permitted by law, we are not responsible or liable for the acts, omissions, errors, delays, failures, or any deficiencies of any Accommodation Provider, including but not limited to a failure to provide services as booked or to meet any of your expectations. All accommodation bookings are subject to the Accommodation Provider's terms and conditions. Such terms and conditions govern any dispute, claim or complaint arising from the services provided by the Accommodation Provider you select.
2.3 Third-Party Content
Descriptions, photographs, amenity lists, ratings, and other information about Accommodation Providers displayed on our Platform ("Third-Party Content") are provided by our suppliers and the Accommodation Providers themselves. The Third Party Content provided by our suppliers are for general informational purposes and may not reflect the current layout, décor, or current condition of the Accommodation Provider, including but not limited to any furnishings, amenities, cleanliness, safety or maintenance. While we strive to display accurate information, we do not independently verify Third-Party Content and make no representations or warranties regarding its accuracy, completeness, or reliability. We cannot guarantee that the Third Party Content provided by a supplier or Accommodation Provider will match your standards and expectations. We are not responsible for any disappointment or dissatisfaction you may have as a result of your experience as a guest of any Accommodation Provider or other supplier. You acknowledge that you are responsible for conducting your own due diligence before making any booking.
3. Account Requirements
3.1 Eligibility
To create an account and use the Platform, you must:
- Be at least 18 years of age
- Be legally capable of entering into binding contracts
- Be a resident of the United States
- Provide accurate and complete registration information
By creating an account, you represent and warrant that you meet all eligibility requirements.
3.2 Account Registration
You must create an account to complete bookings on the Platform. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and current
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access to your account
3.3 One Account Per Person
Each individual may maintain only one account. You may not create multiple accounts or share your account with others.
3.4 Account Holder Must Be a Traveler
The account holder must be one of the travelers on any booking made through the Platform. You may not book accommodations solely on behalf of others who are not traveling with you. If you are not traveling or do not intend to travel on a booking that you have made, your booking must be modified to include an account holder who will be traveling. Failure to adhere to this policy may result in temporary or permanent suspension of your access to the Platform without notice.
4. Bookings and Reservations
4.1 Booking Process
When you submit a booking request through the Platform, you are making an offer to book accommodations at the displayed price. A binding contract is formed only when we confirm your booking and your payment has been successfully processed.
4.2 Prices Not Guaranteed Until Booked
Prices displayed on the Platform are subject to change at any time until a booking is confirmed. Adding an accommodation to your cart does not reserve the price or guarantee availability. Prices may increase or decrease between the time you view a rate and the time you complete your booking. The price is only guaranteed once your booking is confirmed and payment is successfully processed.
4.3 Price Display
Prices displayed on the Platform include applicable taxes and fees, except for any city taxes, tourist taxes, resort fees, or similar charges that must be paid directly to the Accommodation Provider at the time of your stay. These additional charges, if applicable, will be disclosed to you before you complete your booking.
4.4 Room Limitations
You may book a maximum of five (5) rooms per booking. Bookings of six or more rooms are considered group bookings and are not available through our standard booking process.
4.5 Rate Types
Accommodations may be offered at different rate types, including:
- Cancellable Rates: May be cancelled in accordance with the cancellation policy displayed at the time of booking.
- Non-Refundable Rates: Cannot be cancelled or refunded under any circumstances. Once booked, you are responsible for the full amount regardless of whether you use the reservation.
Please carefully review the rate type and cancellation policy before completing your booking.
4.6 Booking Confirmation
Upon successful completion of your booking and payment, you will promptly receive a confirmation email containing your booking voucher and reference number. The voucher will include essential information about your booking and must be presented at check-in. Please verify all information on your confirmation for accuracy and contact customer support immediately if you notice any errors at hello@gowithrosie.com. In the event that your booking cannot be processed by the Accommodation Provider following payment, you will receive a message and prompt refund in full. You may attempt to re-book, or reach out to customer service for additional assistance.
4.7 Pricing Errors
In the event of an obvious pricing error (such as a rate that is more than 50% below comparable rates for similar accommodations), we reserve the right to cancel your booking or offer you the option to rebook at the correct price. If your booking is cancelled due to a pricing error, we will refund any amounts paid. We will make reasonable efforts to notify you promptly if a pricing error affects your booking.
5. Payment
5.1 Payment Requirements
Full payment is required at the time of booking. Your booking will not be confirmed until payment is successfully processed. We accept payment by credit card, debit card, and ACH bank transfer. All payments are processed in United States Dollars (USD).
5.2 Payment Processing
Payments are processed through our third-party payment processor, Stripe. By providing your payment information, you authorize us to charge the applicable amount for your booking. We do not store your full credit card number; only the last four digits and card brand are retained for transaction records.
5.3 Payment Authorization for Incidentals and Damages
When you arrive at your Accommodation Provider, you may be required to provide a valid credit card incidentals, deposits, and for any damages. You accept full responsibility for any damage or loss caused by you or any guest traveling with you. Full payment for any such damage, loss, fees or charges must be paid directly at the time to the Accommodation Provider. We do not control any such charges or any amounts assessed by an Accommodation Provider with respect to any damage or alleged damage caused by you or your guests during your stay or charges for any other reason with respect to your stay.
By making a booking, you authorize us to retain your payment method on file and charge it for any amounts owed under these Terms, including but not limited to:
- Damage to Accommodation Provider property caused by you or members of your traveling party
- Incidental charges incurred during your stay (minibar, room service, etc.) if charged to us by the Accommodation Provider
- Fees or penalties resulting from your violation of Accommodation Provider policies
- Any other charges for which you are responsible under these Terms
Before charging your payment method for such amounts, we will make reasonable efforts to notify you and provide documentation of the charges.
5.4 Failed Payments
If your payment fails, your booking will not be confirmed. If a payment failure occurs after initial authorization but before final processing, we will attempt to notify you and provide an opportunity to submit alternative payment. If payment cannot be successfully processed, your booking may be cancelled.
5.5 CHARGEBACK DISPUTES
EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS, INCLUDING CANCELLATIONS FEES. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, WE RESERVE THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
6. Cancellations and Refunds
6.1 Cancellation Policies
Each booking is subject to the specific cancellation policy displayed at the time of booking. Cancellation policies are set by the Accommodation Providers and vary by property and rate type. You are responsible for understanding and accepting the applicable cancellation policy before completing your booking.
6.2 How to Cancel
To request a cancellation, submit your request directly through the Go With Rosie website by viewing your booking confirmation. Once submitted, you will receive a confirmation email acknowledging your pending cancellation request, and our support team will be notified.
Cancellations are not automatic. Our team will review your request and contact you to confirm the cancellation, advise on any applicable refund eligibility, or communicate any financial impacts (such as partial refunds or non-refundable amounts) that may apply based on the supplier's cancellation policy. Your cancellation will only be considered final once confirmed by email.

6.3 Non-Refundable Bookings
Non-refundable bookings cannot be cancelled, changed, transferred, modified, or refunded for any reason, including but not limited to changes in travel plans, emergencies, travel disruptions or delays, force majeure events, illness, weather conditions, or any other personal circumstances whether foreseeable or unforeseeable. By booking a non-refundable rate, you knowingly accept full financial responsibility for the reservation and waive your right to a refund or credit for any reason whatsoever.
6.4 No-Shows
If you fail to check in to your accommodation without cancelling your booking in advance (a "No-Show"), this will be treated as a cancellation and you will forfeit any right to a refund. The Accommodation Provider may charge up to 100% of the booking amount for No-Shows, and you will be responsible for this charge. Once your stay begins, you cannot cancel the remaining nights for a refund. If you are not able to arrive within the check-in window of the Accommodation Provider for any reason, including the delay of any third-party, it is your sole responsibility to notify the Accommodation Provider. We are not responsible if an Accommodation Provider cancels, modifies or imposes a fee on your reservation for your failure to arrive when your booking is schedule to commence.
6.5 Refund Processing
Where a refund is due under the applicable cancellation policy, refunds will be processed to the original payment method within ten (10) business days of the approved cancellation. Please note that your bank or card issuer may take additional time to post the refund to your account.
6.6 Our Right to Cancel
We reserve the right to cancel your booking in the following circumstances:
- Pricing errors as described in Section 4.7
- Accommodation Provider insolvency, closure, or inability to honor the reservation
- Your violation of these Terms or the policies of the Accommodation Provider
- Suspected fraud or unauthorized use of payment methods
- Force Majeure events as described in Section 14
If we cancel your booking for reasons other than your violation of these Terms, including but not limited to insolvency, bankruptcy, or cessation of business operations of an Accommodation Provider, we will refund any amounts paid. We will use commercially reasonable efforts to assist you in finding alternative accommodations, but we are not obligated to do so and are not responsible for any price differences or additional costs. Our only responsibility to you in the event of cancellation is to refund the original amount you paid. We are not responsible for any additional, indirect, or consequential costs resulting from the cancellation of your booking or the impact the cancellation may have on your trip.
7. Modifications to Bookings
7.1 Requesting Modifications
Modifications to confirmed bookings (including date changes, room type changes, and guest name changes) are not guaranteed and must be requested through our customer support team at hello@gowithrosie.com. All modifications are subject to availability and approval by the Accommodation Provider.
7.2 Name Changes
Guest name changes after booking confirmation require approval from our suppliers and may not be permitted. If a name change is approved, additional fees may apply.
7.3 Price Adjustments
If your requested modification results in a price increase, you will be responsible for paying the difference before the modification is confirmed. If your requested modification results in a lower price, we will refund the difference to your original payment method in accordance with Section 6.5. Modifications that change the rate type or cancellation policy will be subject to the new terms.
8. Customer Conduct and Responsibilities
8.1 Traveler Documentation
You are solely responsible for ensuring that all travelers in your party have valid identification and any required travel documentation (passports, visas, real-ID, valid driver's license, etc.) for your destination. We are not responsible for any issues arising from inadequate documentation. You will need to show a valid form of identification upon your arrival to your Accommodation Provider. The information on the identification you provide must match the information on your reservation. Any discrepancies may lead to cancellation of your booking.
8.2 Compliance with Property Rules
You and all members of your traveling party must comply with the terms and conditions, rules, policies, and regulations of the Accommodation Provider. It is your sole responsibility to be familiar with and follow any policies imposed by an Accommodation Provider including but is not limited to check-in/check-out times, occupancy limits, noise policies, pet policies, and smoking policies.
8.3 Prohibited Conduct
You agree that you and members of your traveling party will not:
- Exceed the stated room occupancy limits
- Sublet, sublicense, or allow third parties not named on the booking to use the accommodation
- Engage in any illegal or prohibited activities on the premises
- Cause damage to the property, furnishings, or equipment
- Engage in disruptive, disorderly, menacing, threatening, or abusive behavior toward staff, or other guests
- Use the accommodation for commercial purposes, including filming, events, or parties without prior authorization from the Accommodation Provider
- Remove or damage property belonging to the Accommodation Provider
- Interfere in any way with any operations of the Accommodation Provider.
8.4 Consequences of Violations
Violation of these conduct requirements may result in immediate termination of your reservation without refund, eviction from the property, and liability for any damages, costs, or penalties incurred. The Accommodation Provider reserves the right to refuse service and to take legal action as appropriate.
8.5 Supervision of Children
You are solely responsible for the conduct, safety and general well-being of the minors traveling with you at all times while on the premises of an Accommodation Provider. We do not own, operate, manage, supervise, or control any resort activities, facilities, or programs, and we make no representations regarding their safety, supervision, staffing, or suitability for minors.
8.6 Assumption of the Risk of Participating in Activities
Many our Accommodations Providers offer access to amenities and activities that may involve inherent risks, including but not limited to swimming pools, hot tubs, water sports, beaches, kids clubs, gyms, spas, recreational activates and excursions. You acknowledge that you are aware that the physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You may be required to wear approved safety equipment while participating in certain activities and you agree to use the recommended safety equipment and to ask questions if you are unsure about how to properly or safely use equipment. If you use, consume, or are under the influence of alcohol or illegal drugs prior to or while engaging in any activities. YOU ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS THAT MAY RESULT INCLUDING THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS, even in the event of negligence or fault by an Accommodation Provider.
8.7 Liability for Damages
You are financially responsible for any damage to Accommodation Provider property caused by you or members of your traveling party during your stay. By making a booking, you authorize us to charge your payment method on file for any such damages as described in Section 5.3.
9. Travel Insurance
We strongly recommend that you purchase travel insurance for your trip. Travel insurance can provide coverage for unexpected events and costs you may incur from trip cancellation, lost baggage or personal effects, delay, interruption, default and bankruptcy protection, missed connections, injury, illness, medical expenses, medical emergencies, and other travel-related issues. We are not responsible for losses that could have been covered by travel insurance. Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, portions of the trip may not be refunded and cancellation penalties may apply, resulting in the loss of monies up to the full cost of your booking.
We may offer travel insurance through third-party insurance providers. If you purchase travel insurance through our Platform, such insurance is provided by the third-party insurer, not by us. We may receive compensation for referring you to such insurance providers. We are not a licensed insurance broker, and our staff is not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured's existing insurance coverage. It is your responsibility to know what your insurance policy covers. Any claims under such policies must be made directly with the insurer in accordance with the policy terms. We make no representations about the extent of coverage for any policy that we may offer access to. We cannot guarantee that any insurance provider will approve coverage for any claim you may make.
10. User-Generated Content
10.1 Your Content
The Platform may allow you to submit reviews, recommendations, ratings, and other content ("User Content"). You retain ownership of your User Content, but by submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, display, distribute, and create derivative works of your User Content in connection with the Platform and our business.
10.2 Content Standards
You agree that any User Content you submit will not:
- Be false, misleading, or deceptive
- Infringe or misappropriate the intellectual property, or privacy rights of any third party
- Contain defamatory, obscene, abusive, hateful, perverse, threatening, harassing or objectionable content
- Violate any applicable law or regulation
- Contain viruses, spyware, malware, or other harmful code
- Contain spam, junk, promotions or advertisements
- Constitute spam or unauthorized advertising
- Impersonate another person or entity or misrepresent your identity.
10.3 Content Moderation
We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion. We may remove content that we believe violates these Terms or is otherwise objectionable without notice. We may disclose User Content or other relevant information to law enforcement when required by law or if necessary to protect our rights.

10.5 Copyright Infringement (DMCA)
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information in writing: (1) a physical or electronic signature of the copyright owner or authorized agent; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material that is claimed to be infringing; (4) your contact information; (5) a statement that you have a good faith belief that use of the material is not authorized; and (6) a statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner. 11. Family Recommendations Feature
11.1 How It Works
Our Platform may share travel recommendations and preferences between users with similar family profiles ("Like Families"). This feature uses attributes you provide (such as children's ages, travel preferences, dietary needs, and interests) to identify other families with similar profiles and share relevant recommendations.
11.2 Anonymity
We never disclose your identity or any identifiable characteristics to other users. Recommendations are shared anonymously. Other users will not know who you are, your name, email, or any personally identifying information. They may only see that "a family like yours" enjoyed a particular venue or activity.
11.3 Accuracy of Recommendations
Recommendations from Like Families are based on their subjective experiences and preferences. We do not guarantee that any recommendation will be suitable for your family. You are responsible for evaluating whether a recommended venue, activity, or accommodation is appropriate for your family's needs.
12. Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as incidental to normal use of the Platform.
13. Privacy
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of information as described in our Privacy Policy. We are committed to protecting your privacy and will never sell your personal information to third parties.
14. Force Majeure
Neither we nor our suppliers shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to: acts of God; natural disasters; fires, epidemics; pandemics; disease outbreaks; war; acts of terrorism or threats of terrorism; riots; government mandated lockdowns or evacuations, civil unrest; government actions or travel restrictions; strikes; labor disputes; transportation disruptions; power failures; breakdown of communication systems, or any other event that could not reasonably be anticipated or controlled (collectively, "Force Majeure Events").
In the event of a Force Majeure Event affecting your booking:
- For cancellable bookings, we will process cancellations in accordance with the applicable cancellation policy
- For non-refundable bookings, we will use commercially reasonable efforts to work with the Accommodation Provider to find a solution, but we cannot guarantee refunds or rebooking
We are not responsible for additional costs incurred due to Force Majeure Events, including but not limited to alternative accommodations, transportation, or extended stays.
WE STRONGLY RECOMMEND PURCHASING TRAVEL INSURANCE TO PROTECT AGAINST LOSSES CAUSED BY FORCE MAJEURE EVENTS.
15. Travel Advisories
We advise you to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations using our Platform. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/
16. Limitation of Liability
16.1 Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, SERVICES, AND ACCOMMODATIONS MADE AVAILABLE THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
16.2 Limitation on Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; (D) THE ACTS OR OMISSIONS OF ANY ACCOMMODATION PROVIDER; OR (E) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
16.3 Accommodation Provider Liability
We are not liable for any acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any Accommodation Provider, or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. This includes but is not limited to issues related to overbookings, service quality, amenities, cleanliness, safety, or any other aspect of the accommodation.
When traveling outside of the United States or Canada, laws and regulations will often apply different standards of accommodation for travelers with disabilities or special needs. We are not responsible for the failure of any Accommodation Provider failing to meet the needs of travelers or failure to comply with the laws and regulations of the local jurisdiction. Additionally, the laws and regulations of local jurisdictions covering travelers with disabilities or special needs may change without prior advance notice. Travelers with disabilities or special needs who may require special accommodations are advised to advise the Accommodation Provider in advance of your arrival of any special requests or requirements. We are not responsible for the failure of an Accommodation Provider to accommodate any special requests.
17. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates, and each of its respective officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all claims, losses, expenses, damages, judgements, and costs, including reasonable attorneys' fees, arising out of or relating to
- Your use of the Platform
- Your breach of these Terms, or any applicable laws
- Your violation of any rights of any third party, including any Accommodation Provider or other supplier
- Any User Content you submit or post on our Platform
- Any damage to person or property caused by you or members of your traveling party during your stay at the property of an Accommodation Provider
- Any damage or
Or arising from your conduct, or the conduct of any person traveling with you, including minors, during your stay at an Accommodation Provider or any other service booked through the Platform. Conduct includes but is not limited to damage to your accommodations, damage to any person or property, missing items, failure to pay for incidentals or other charges you incur, the violation of any policies of an Accommodation Provider or any law or regulation.
This indemnification obligation will survive termination of these Terms, the completion of your trip, and your use of the Platform.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating any formal legal proceeding, you must first contact us at hello@gowithrosie.com and attempt to resolve any dispute informally. Please provide the details of your complaint in an email. We will acknowledge your receipt of your complaint and review it within three business days and will promptly work to resolve it within 90 days. Resolution may include forwarding your complaint to the Accommodation Provider or supplier. We may reach out to you for more information regarding your complaint via email.
18.2 Class Action Waiver
YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Unless both you and the Company agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
18.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the courts of the State of Delaware or the United States District Court for the District of Delaware, and you consent to the personal jurisdiction of such courts. Any claim against us must be brought within twelve months after the date of the completion of your booking and not later. You agree that we shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You hereby irrevocably and unconditionally waive to the fullest extent permitted by law any right to a trial by jury in any legal proceeding with respect to any claim you may assert derived from using our Service or a booking you make with us.
19. Termination
19.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Termination of your account does not release you from any obligations incurred prior to termination, including payment obligations for confirmed bookings.
19.2 Termination by Us
We may suspend or terminate your account and access to the Platform at any time, with or without cause, with or without notice, including but not limited to if we believe you have violated these Terms. Upon termination, your right to use the Platform will immediately cease.
19.3 Effect of Termination
Upon termination: (a) all rights granted to you under these Terms will cease; (b) you must cease all use of the Platform; (c) any confirmed bookings will remain subject to their applicable terms and cancellation policies; and (d) provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5.3 (Payment Authorization), 8.5 (Liability for Damages), 10.1 (Your Content license grant), 15 (Limitation of Liability), 16 (Indemnification), and 17 (Dispute Resolution).
20. Miscellaneous
20.1 Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and the Company regarding the Platform and supersede all prior agreements and understandings.
20.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
20.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of the Company.
20.4 Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice or consent. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.
20.5 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on the Platform and updating the "Effective Date" at the top. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Platform.

We may provide notices to you via email, posting on the Platform, or other reasonable means. You may provide notice to us at hello@gowithrosie.com.
